APPLICANT REQUESTS THAT:

He be promoted to the grade of Airman First Class (A1C/E-3).

APPLICANT CONTENDS THAT:

He was awarded the Boy Scouts of America Eagle Scout Award prior to entering active duty, and this award warrants promotion  to E-3.  

The applicant’s complete submission, with attachment, is at Exhibit A.

STATEMENT OF FACTS:

The applicant initially entered the Regular Air Force on 15 Jan 13, in the grade of Airman (E-2).  

On 15 Mar 13, the applicant was promoted to Airman First Class (A1C/E-3).

The remaining relevant facts pertaining to this application are contained in the letter prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C.

AIR FORCE EVALUATION:

AFPC/DPSIPE recommends denial, indicating there is no evidence of an error or injustice.  The member is requesting correction of his pay grade to the grade of E-3 for receiving the Eagle Scout Award prior to entering active duty.  AFRSI 36-2001, Recruiting Procedures of the Air Force, states the enlistment grade for award of a Boy Scouts of America Eagle Scout Award will be Airman (E-2).  The applicant’s AF Form 3007, Supplement to Enlisted Agreement—United States Air Force, dated 18 Oct 12, indicates his initial grade as E-2.  There is no error or injustice.  Recommend denying the applicant’s request for advancement to E-3/Airman First Class.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 24 Jul 13 for review and comment within 30 days.  As of this date, no response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice.  We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice.  Further, the Board notes the applicant’s Date of Rank to the grade of Airman First Class (E-3) is the date he graduated from Basic Military Training in compliance with the enlistment contract he signed on 8 Oct 12.  Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application.

The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
